1. Agreement to Terms
By accessing and using this application ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to decompile or reverse engineer any software contained on the Service
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
- Violate any applicable laws or regulations
3. Disclaimer
The materials on the Service are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
4. Limitations
In no event shall our company or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Service, even if we or our authorized representative has been notified orally or in writing of the possibility of such damage.
5. Accuracy of Materials
The materials appearing on the Service could include technical, typographical, or photographic errors. We do not warrant that any of the materials on the Service are accurate, complete, or current. We may make changes to the materials contained on the Service at any time without notice.
6. Materials and Content Ownership
The materials on the Service, including but not limited to text, software, photographs and other images, graphics, music, sound and video, and their arrangement on the Service (collectively, the "Content") are owned by us, our licensors, or both, and are protected by copyright and other intellectual property laws.
7. User-Generated Content
Users may submit content to the Service. By submitting content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, and distribute it in any media.
You represent and warrant that you own or control all rights to the content you submit and that such content does not violate any applicable laws or these Terms of Service.
8. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account information and password
- You agree to accept responsibility for all activities that occur under your account
- You agree to notify us immediately of any unauthorized use of your account
- We reserve the right to refuse service, terminate accounts, or remove content
9. Payment and Billing
- All fees are stated in the currency specified on the Service
- Billing occurs automatically on a recurring basis as specified in your subscription plan
- You are responsible for providing accurate billing information
- We reserve the right to change fees or billing methods with 30 days' notice
- Refunds are not available except as required by law
10. Refund Policy
- Subscription fees are non-refundable except as required by applicable law
- If you wish to cancel your subscription, you must do so before the next billing date
- Upon cancellation, your access will continue until the end of your billing period

10.1. 90-Day Money-Back Guarantee
10.1.1. The Guarantee
We want you to be completely satisfied with Watuba. If our platform doesn't meet your needs within the first 90 days of your initial subscription, you are eligible for a refund, subject to the Fair Use requirements below.
10.1.2. Fair Use Requirements
To prevent system abuse and ensure the sustainability of our solo-founder mission, refunds are granted if:
- Usage Threshold: Your account has not exceeded 10 total broadcasts or 50 employee profile creations.
- Data Export: You have not performed a full system data export within 48 hours of the refund request.
- Good Faith: You provide a brief reason for the cancellation (this helps us improve the product for others).
10.1.3. Non-Refundable Processing Fees
Please note that while we refund the subscription price, payment processing fees (typically 3.3% + R2.00 for South African transactions) are retained by the payment gateway and are non-refundable. Your total refund will be the subscription amount minus these third-party costs.
10.1.4. How to Request
To initiate a refund, please email support@watuba.com from the administrative email address associated with your account. Refunds are typically processed within 5–7 business days.
11. Modifications to Service
We reserve the right to modify or discontinue the Service with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
12. Links and Third-Party Services
The Service may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external websites. Your use of third-party services is at your own risk and subject to their terms of service.
13. Prohibited Uses
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit any harmful, offensive, or illegal content
- Attempt to gain unauthorized access to the Service
- Interfere with the operation of the Service
- Engage in any form of harassment or abuse
- Use automated tools (bots, scrapers) without permission
14. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
15. Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or theory of liability, even if we have been advised of the possibility of such damages.
16. Indemnification
You agree to indemnify and hold harmless our company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms of Service
- Your violation of any rights of third parties
- Your user-generated content
17. Termination
We may terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.
18. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
19. Entire Agreement
These Terms of Service constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, understandings, and negotiations, whether written or oral.
20. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts located in South Africa.
21. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to the Service. Your continued use of the Service following the posting of revised Terms of Service means that you accept and agree to the changes.
22. Beta Program
Watuba is currently operating as a beta service. As a beta user, you acknowledge and agree to the following terms specific to our beta program:
22.1. Beta Status and Service Availability
The Service is provided as a beta product and may contain bugs, errors, and incomplete features. While we strive to maintain service reliability, we do not guarantee continuous or uninterrupted availability during the beta period (ending October 31, 2026). Beta users should not rely on the Service for critical business operations without maintaining alternative systems.
22.2. Beta Sign-Up Deadline
Sign-ups for the beta program will close on July 31, 2026. After this date, new account registrations will not be permitted until the Service exits beta and enters full production. Existing beta users will retain their accounts and access beyond the sign-up deadline.
22.3. Beta Pricing and Founder's Rate
As a beta user who signs up before July 31, 2026, you are eligible for our exclusive founder's rate of ZAR 19 per seat per month when the Service transitions to full production (after October 31, 2026). This special pricing is guaranteed for the lifetime of your account, provided you maintain a continuous subscription with no cancellation periods longer than 30 days.
22.3.1. Beta Account User/Seat Limit
During the beta period, beta accounts are limited to a maximum of 50 users/seats. After the app launches and transitions to full production (after October 31, 2026), you will be able to increase your seat allocation as necessary to accommodate your organization's growth and requirements.
22.4. Data and Feature Changes
During the beta period, we may modify, reset, or delete user data as part of testing and development activities. While we will make reasonable efforts to preserve data, we do not guarantee data permanence during beta. Users should not store critical production data in the Service without maintaining backups.
22.5. Feedback and Testing
As a beta user, you agree to provide feedback on your experience with the Service. We may monitor usage patterns and collect diagnostic information to improve the product. By participating in the beta program, you grant us permission to use your feedback and experience data (with all personally identifiable information removed) for product development purposes.
22.6. Transition to Production
Upon the conclusion of the beta program (October 31, 2026), all users will be migrated to the standard production environment. We will provide at least 30 days' notice before this transition. Standard subscription terms will apply to all users after the beta period concludes, except for beta users who retain their founder's rate pricing for life.
